Terms of use
Certified Payroll Kit is a formatting tool. It puts data you provide into certified payroll formats and checks arithmetic and structure. It does not give legal, tax or payroll advice and does not submit anything on your behalf.
1. Your responsibilities
You are responsible for the data you use, for paying at least the applicable prevailing wage and fringe rates, for choosing the correct classifications, for reviewing every document before you use it, and for signing and submitting it. Before downloading you confirm that you have checked the figures. Certified payrolls are signed statements made under penalty of law; using our tools does not transfer that responsibility to us.
2. What the tools do and don't do
We fill official forms and generate files from your data, and flag inconsistencies such as totals that don't add up. We do not look up or verify wage determinations or rates, and we can't guarantee that an agency or system will accept a document. Forms and formats change; we monitor official sources and update the tools, but you should check that you are using the current version required by your contract.
3. Free and paid use
The WH-347 generator and the XML checker are free. Paid plans (for state formats such as the California DIR eCPR XML) are billed monthly or yearly through Stripe, per company, and renew automatically until cancelled. You can cancel at any time in the customer portal; access continues until the end of the paid period. If something doesn't work for you in the first 14 days of a paid subscription, ask and we'll refund it.
4. Acceptable use
Don't use the service to break the law, to submit false payrolls, to attack or overload the site, or to resell it without our permission.
5. Liability
The service is provided "as is". To the extent the law allows, we are not liable for indirect or consequential loss, for withheld or delayed payments, penalties or assessments arising from documents you submit, or for loss of data stored in your browser. Our total liability to you in any 12-month period is limited to the amount you paid us in that period. Nothing in these terms limits liability that cannot be limited by law, such as for fraud or for death or personal injury caused by negligence.
6. Not affiliated
We are independent and not affiliated with or endorsed by the U.S. Department of Labor, the California Department of Industrial Relations, LCPtracker, Intuit or Gusto. Product names are used only to describe compatibility.
7. Changes and law
We may update these terms; the effective date above shows the current version, and material changes for paying customers will be emailed. These terms are governed by the law of England and Wales, and its courts have jurisdiction. Questions: [email protected].
